Car Park Terms and Conditions

For the purpose of these Terms and Conditions, the development known as “ICD Brookfield Place” is defined as the “Building”, ICD Brookfield Place Limited is defined as the “Owner” and all those individuals operating or who are a passenger in a vehicle within the Building are defined as a “User(s)”.

These Terms and Conditions govern the use of the parking facility in the Building and by accessing the parking facility, each User acknowledges, accepts and agrees to adhere to and be bound by these Terms and Conditions.

  1. Visitor paid parking spaces are located in the Basement 1 and Basement 2 levels of the Building (“Visitor Car Park”). The User must pay the parking fee specified on the tariff signage, with such fee to be paid at the automatic pay machines located in the lift lobbies.
  2. Tenant parking is located on Basement 3 to Basement 7 of the Building (“Tenant Car Park”). Only those Users who are registered with and authorised by the Owner to use a parking space within the Tenant Car Park may access the Tenant Car Park. Unauthorised Users must not use or seek to access any areas other than the Visitor Car Park.
  3. Any User who is authorised to use the Tenant Car Park, but parks a vehicle in the Visitor Car Park, is subject to the applicable Visitor Car Park tariffs under Paragraph 1 of these Terms and Conditions.
  4. From payment of a visitor parking ticket, there is a 15 minute grace period for the User’s vehicle to exit the car park. After the expiration of this period, standard visitor parking charges will apply.
  5. Users shall ensure that it is no obstruction to other vehicles, doors, entrances, firefighting, emergency exits or other zones which are not designated for parking at any time.
  6. Users must ensure that their vehicle is parked within one (1) parking space (i.e. inside relevant line markings). Motorbikes must be parked within designated motorbike bays.
  7. “Reserved” bays are strictly reserved for use by the designated User. Unauthorised Users must not park in any parking space that is reserved, allocated or designated for use by any other party. Authorised Users of “Reserved” bays must park within their designated reserved parking space.
  8. Users must promptly switch off vehicles and vehicles must not be left idling whilst in the parking spaces.
  9. Users must not leave children under the age of 18 years or pets unattended in vehicles (i.e. without an accompanying adult).
  10. The User shall adhere to all displayed rules and proper markings in respect of speed limits, traffic flow, ingress and egress.
  11. Sleeping in vehicles is prohibited.
  12. Tailgating is strictly prohibited when using the car park.
  13. The car park is monitored by 24/7 CCTV surveillance.
  14. Users must not cause or allow any rubbish to be placed, thrown or dropped in the car park.
  15. Smoking is strictly prohibited in the Building, including within the car park and in any vehicles located in the car park at all times.
  16. Parking spaces can only be used for motor vehicle parking. Users are not permitted to use the car park for storage of equipment, materials, furniture or other property.
  17. No scooters, bicycles or skateboards are permitted to be use in the Building.
  18. User must not bring any vehicle into the car park which is unsafe, leaks oil/fluids or which contains inflammable, volatile, or explosive substances.
  19. All commercial / trade activities, unless pre-authorised by the Owner, are prohibited in the car park.
  20. Overnight parking is not permitted between the hours of 4:00 am to 6:00 am. An AED200 plus VAT penalty applies for any breach of this regulation.
  21. The User is fully responsible for their vehicle belongings in regard to any additional cleaning services agreed to be provided by any third party provider.
  22. Disabled parking spaces are strictly reserved for legitimate Users. Registered identity passes issued by the authorities must be displayed at all times.
  23. Users must obey the directions of car park staff and security personnel at all times. Users should immediately report incidents, accidents, property damage and suspicious events to the the car park staff and security personnel.
  24. The User is fully responsible for any damage caused to the Building or other vehicles by their use of the parking area.
  25. The Owner will not be held responsible for theft or damage to and/or from any vehicles within the parking areas, or the exercise of any of the Owner’s rights in accordance with applicable law or these Terms and Conditions. Vehicles must always be locked and secured when left unattended. Any vehicles parked in the facility are done so entirely at the User’s and the vehicle owner’s risk. The User and the vehicle owner releases the Owner for and agrees that the Owner will have no liability or responsibility for any loss of property or damage to the vehicle.
  26. Users must ensure that their vehicles are (i) registered with the relevant authorities; (ii) in roadworthy and safe operable condition; and (iii) insured for at least third party liability.
  27. If a User fails to comply with any of these Terms and Conditions, the Owner reserves the right to, without limitation (i) deactivate and restrict access to a User’s car park access privileges at any time; or (ii) refer the violation to the relevant authorities, which may result in the offending vehicle being removed from the Building.
  28. Any personal data submitted by Users to the Owner shall be held pursuant to the Brookfield Data Protection Policy – https://www.brookfieldproperties.com/privacy/.

The Owner reserves the right to vary these Terms and Conditions from time to time at their sole discretion. Such variations shall be applicable and binding on the User from the time they are displayed at the Building.

These Terms and Conditions shall be governed by and construed in accordance with the laws of DIFC and the UAE applicable thereto. The User agrees to submit to the exclusive jurisdiction of DIFC courts in respect of any dispute in connection with these Terms and Conditions or the User’s use of the parking facility.

Standard Valet Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY RELATE TO YOUR USE OF THIS VALET PARKING SERVICE.

By using our valet parking services (“services”) you (“customer”) agree to the following terms and conditions (“Terms and conditions”). These Terms and conditions shall apply when ICDBP or any of its agents accept the vehicle and whilst the vehicle is parked, or otherwise in custody, retention or control of ICDBP or its agents.

  1. In respect of the vehicle (“vehicle”) the customer presents to ICDBP or its agent, customer represents and warrants that, Customer is either;
  2. The owner of the vehicle or,
  3. (ii) Customer is the authorized agent of the owner of the Vehicle and is authorized by the owner of the Vehicle to bind the owner to these Terms and conditions.
  4. The Customer warrants that the Vehicle is registered with the concerned authorities and covered by comprehensive motor vehicle insurance as required under the laws of UAE.
  5. ICDBP or its agent shall not accept any goods, stored in vehicle, for safe custody and do not accept responsibility for the same.
  6. Under no circumstances shall ICDBP or its agent be liable to the customer for the following:

(i) For damage or injury sustained through faulty brakes, electrical failure, mechanical failure or other equipment failure in the vehicle. This includes but is not limited to windscreens, all glass, mirrors, tyres and wheels howsoever caused.

(ii) For any minor scratches, dents or damage to customer’s vehicle which may not be possible to identify in confined times and weather conditions at the time of handing over the vehicle to ICDBP or its agents.

(iii) For providing a replacement car or any rental costs related thereto in case of an accident / damage caused to the Vehicle.

(iv) For any valuables left in the Vehicle such as mobile phones, laptop, computer, CD’s, tapes, jewelry and any cash money or any keys or valuables left on the key ring, which includes but is not limited to electronic remote key fobs.

(v) For delay in the performance of its obligations, or any damage caused as a result of an event of force majeure which includes but is not limited to earthquakes, floods, foe, storms, natural disasters, acts of God, wars, terrorism, armed conflict, labor strike, lockout, boycott or other similar events beyond the reasonable control of ICDBP or its agents.

(vi) For acts of third parties or any damage caused other than resulting from ICDBP or its agents negligence or breach of its obligations.

(vii) For any damage caused which is covered by the customer’s insurance policy which includes but is not limited to the cost of the insurance excess policy and replacement hire cars.

(viii) For damage [if any] caused while inflating the tyres in cases where the customer’s vehicle acquires a puncture or whilst jump starting the vehicle if required.

(ix) For any deterioration in the condition of the Vehicle whilst in ICDBP or its agents custody.

(x) For releasing the vehicle without liability to any person:

a. Producing a valid valet card, or

b. Offering other evidence of ownership or authority or entitlement to receive the vehicle that ICDBP or its agent deem satisfactory.

5. Notwithstanding any demand or request to the contrary, ICDBP or its agents may move and drive the vehicle to such places as they deem fit during any period of custody, retention or control by them.

6. Customer shall be liable for and agrees to indemnify ICDBP or its agent against all losses, liabilities, suits, judgments, claims, costs (including legal costs), damages or expenses arising out of or in connection with customer’s vehicle, its accessories or contents including personal injury to or death of any person or any injury or damage to property except to the extent that such losses are directly caused by ICDBP or its agents negligence or wrongful act or omission.

7. Payment for valet services, should be made against valid valet parking ticket.

8. All claims must be presented to ICDBP or its agent at the time of handing over the possession of the vehicle back to the customer, failing which no such claim shall be heard. Any dispute in relation to a claim shall be heard and determined by ICDBP or its agent in its sole discretion.

9. ICDBP or its agent may retain the Vehicle until a valid valet card is produced or the customer offers such other evidence of ownership or authority or entitlement to receive the vehicle that ICDBP or its agent deems satisfactory. The customer shall be responsible for all costs associated with any such retention.

10. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions

11. ICDBP and its agent reserves the right to vary these Terms and Conditions from time to time at their sole discretion. Such variations shall be applicable and binding on the customer from the time they are displayed at the site.

12. These Terms and Conditions shall be governed by and construed in accordance with the laws of DIFC and the UAE applicable thereto. The customer agrees to submit to the exclusive jurisdiction of DIFC courts.

Electronic Scooters Terms and Conditions

For the purpose of these Terms and Conditions, the development known as “ICD Brookfield Place” is defined as the “Building”, ICD Brookfield Place Limited is defined as the “Owner” and all those individuals operating an electric scooter (“E-Scooter“) within the Building are defined as a “User(s)”.

These Terms and Conditions govern the use and parking of E-Scooters in the facility and the Building generally and by accessing the facility and the Building, each User acknowledges, accepts and agrees to adhere to and be bound by these Terms and Conditions.

  1. Users acknowledge, accept and agree to adhere to, and be bound by, the Car Parking Terms and Conditions, which are ancillary to these Terms and Conditions and are deemed to be repeated in these Terms and Conditions.
  2. The parking for E-Scooters is located on those parts of Basement 5 of the Building clearly designated by the Owner and marked as an E-Scooter parking area (“E-Scooter Parking Area“). The E-Scooter Parking Area must only be used by employees of any Tenant and for the parking of E-Scooters only. The parking of bicycles in the E-Scooter Parking Area is strictly prohibited.
  3. Users must only access the E-Scooter Parking Area through the passenger lifts in the Building designated for such purpose by the Owner from time to time and accessing the E-Scooter Parking Area via the parking ramps is strictly prohibited. When entering the Building, all Users must disembark from the E-Scooter and must not ride the E-Scooter through any parts of the Building, including through Basement 5.
  4. Users must only park their E-Scooter in the racks located in the E-Scooter Parking Area, with the E-Scooter to be parked in an orderly manner so as not obstruct other Users for parking, accessing and/or removing their E-Scooter. Where there are no racks available in a section of the E-Scooter Parking Area, the User must park their E-Scooter in an alternate E-Scooter Parking Area available on Basement 5. If no racks are available in the E-Scooter Parking Area, the E-Scooter must not be parked in another location of the parking facility and the User store the E-Scooter at the User’s place of employment.
  5. Users must ensure that their name and contact number is displayed on their E-Scooter to enable the Owner to identify and contact (if required) the User.
  6. Users shall not store any ancillary equipment (including helmets or any other safety equipment) with their E-Scooter or in the E-Scooter Parking Area generally, with Users to store any such equipment at their place of employment.
  7. Users must secure their E-Scooter to a rack within the E-Scooter Parking Area and Users will not be permitted to charge their E-Scooter from any power source that may be located in, or within the vicinity of, an E-Scooter Parking Area. In the event of a breach of this rule by a User, the Owner will be entitled to disconnect any User’s E-Scooter from any such power source and will be entitled to levy a penalty of AED 200 on the User who breaches this regulation.
  8. Overnight parking is not permitted between the hours of 4:00 am to 6:00 am. An AED200 plus VAT penalty applies for any breach of this regulation.
  9. Any E-Scooters parked an E-Scooter Parking Area are done so entirely at the User’s and the E-Scooter’s owner’s risk. The Owner will not be held responsible for theft or damage to and/or from any E-Scooter parked within the E-Scooter Parking Area, or the exercise of any of the Owner’s rights in accordance with applicable law or these Terms and Conditions. The User and the E-Scooter owner releases the Owner for and agrees that the Owner will have no liability or responsibility for any loss of property or damage to the E-Scooter.
  10. If a User’s E-Scooter remains in the E-Scooter Parking Area for more than seven (7) consecutive days, the Owner shall be authorised to cut any safety lock, remove the E-Scooter and store it at the Owner’s discretion. Should the E-Scooter remain unclaimed for more than thirty (30) days, the E-Scooter shall be deemed abandoned by the User and the Owner shall be authorised to dispose of the E-Scooter. All Users release the Owner from any liability whatsoever arising as a result of the exercise of its rights under this regulation.

The Owner reserves the right to vary these Terms and Conditions from time to time at their sole discretion. Such variations shall be applicable and binding on the User from the time they are displayed at the Building.

These Terms and Conditions shall be governed by and construed in accordance with the laws of DIFC and any laws of the UAE that are applicable in the DIFC. The User agrees to submit to the exclusive jurisdiction of DIFC courts in respect of any dispute in connection with these Terms and Conditions or the User’s use of the parking facility.
